TERMS AND CONDITIONS FOR FOODYAC.COM

1. THE NATURE OF OUR SERVICE

FoodyAC.com is an online marketplace operated by TC.C PFA ("The Platform").

Crucial Disclaimer: FoodyAC.com does not prepare food, does not employ delivery riders, and does not act as a party to the transaction between the Client and the Restaurant. We provide only the digital infrastructure to facilitate:

  • Catalog browsing.

  • Table reservations.

  • Ordering for Pickup, Delivery, or Dine-in.

2. CONTRACTUAL RELATIONSHIP

When a Client places an order, a legal contract is formed directly between the Client and the Restaurant. FoodyAC.com is a third-party facilitator and is not responsible for the fulfillment, quality, or legality of the services provided by the Restaurant.

3. RESPONSIBILITIES OF THE RESTAURANT (PARTNERS)

By enrolling on FoodyAC.com, the Restaurant assumes full and exclusive responsibility for:

  • Menu Accuracy: Prices, descriptions, and allergen information (as per EU 1169/2011).

  • Food Safety: Compliance with DSVSA and ANPC regulations regarding food preparation and storage.

  • Legal Compliance: Issuing fiscal receipts (bon fiscal) or invoices directly to the Client.

  • Fulfillment: Ensuring the order is ready for pickup or delivered as promised.

  • Data Protection: Handling Client data shared by the Platform solely for order fulfillment.

4. RESPONSIBILITIES OF THE CLIENT (USERS)

The Client agrees that:

  • Accuracy: They are responsible for providing the correct delivery address and phone number.

  • Payment: They are obligated to pay for any order placed. No-shows for table bookings may result in account suspension.

  • Allergies: It is the Client's duty to check allergen information provided by the Restaurant and contact the Restaurant directly for clarifications.

5. LIMITATION OF LIABILITY (FOR THE PFA)

To the maximum extent permitted by Romanian law:

  • Service Availability: The PFA does not guarantee that the website will be 100% error-free or uninterrupted.

  • Third-Party Actions: The PFA is not liable for any damages (health or financial) arising from the Restaurant's food, the delivery person’s conduct, or the Restaurant’s failure to issue a fiscal receipt.

  • Indirect Damages: The PFA shall not be liable for any indirect, incidental, or consequential damages.

  • Maximum Liability: In any event, the total liability of the PFA toward any user (Restaurant or Client) is limited to the amount of the commission received by the PFA for the specific order in dispute.

6. CANCELLATIONS AND REFUNDS

  • Refunds: Since the payment is for a product prepared by the Restaurant, any refund request must be addressed to the Restaurant. FoodyAC.com may facilitate the communication but is not obligated to provide refunds from its own funds.

  • Cancellations: Orders cannot be canceled once the Restaurant has started preparation.

7. INTELLECTUAL PROPERTY

All content on FoodyAC.com (software, logos, design) is the property of [Your Full Name] PFA. Users may not scrape data, copy the "look and feel," or use the platform for any competitive purposes.

8. MODIFICATIONS OF SERVICE

The PFA reserves the right to modify the commission structure, subscription fees for restaurants, or platform features at any time with [7] days' notice.

9. GOVERNING LAW AND DISPUTES

These Terms are governed by Romanian Law. Any dispute that cannot be settled amicably shall be referred to the competent courts in the city where the PFA is headquartered.
